Substitution of Nonconforming Uses
The Board may permit substitution of a different nonconforming use for a nonconforming use existing on December 5, 1957.

Interpretation of the Zoning Map
The Board will interpret the zoning map when the recorded layout of a street or lot as it actually is on the ground differs from the layout shown on the zoning map or when the location of the boundary line between districts is questioned. In the case of C-1 District Boundary, the Board will contact the Southeastern District office of the Department of Natural Resources to confirm the boundaries and location of wetland areas.

Appeal Administrative Zoning Related Action
The Board may hear and decide appeals where it is alleged there is an error in any order, requirement, decision, determination, grant or refusal made by the Building Inspector or other official in the enforcement and interpretation of the zoning ordinance.

Variances from the Terms, Provisions, or Requirements of the Zoning Code
The Board may grant a variance from the zoning code with conditions if the situation is:
  • A nonrecurring problem
  • An exceptional and extraordinary circumstance or condition which does not apply generally to other properties or uses in the same zoning district
  • Necessary for the preservation and enjoyment of substantial property rights of surrounding properties in the same district.
  • Not substantial detrimental to adjacent properties and will not harm the purpose of the zoning code or the public interest
